Sue Brown and Nick Martin-Clark of the HLA have ended their 4 year legal battle with their volunteer ex-Treasurer, Lynne Zilkha who became a founder member of HLCG. All parties have signed a Court Order.
The Court Order, which is not confidential, is a legally binding contract. This ends Ms Brown and Mr Martin-Clark's expensive High Court action.
The ex-Treasurer, and other members of HLCG, have suffered aggressive attacks and allegations of various wrong doings.
Ms Brown, Mr Martin-Clark and the HLA have now retracted their allegations of wrong doing against their ex-Treasurer. They formally recognise the HLCG as a Borough-wide leaseholder group and accept that the HLCG has its own database.
The allegations began after a letter of complaint from 8 then committee members of the HLA was lodged with Homes for Haringey (HfH) in June 2010. The complaint led to a formal investigation into the HLA by HfH. The findings and procedure of the investigation were later upheld by the Local Government Ombudsman.
HLCG is delighted that Ms Brown, Mr Martin-Clark and the HLA have finally agreed to accept their ex-Treasurer's offer which places a legal obligation on both Ms Brown, Mr Martin-Clark to cease hostilities against their ex-Treasurer and another more recent ex-HLA committee member for all time. This agreement fully exonerates their ex-Treasurer from blame of any alleged wrong doing and protects both individuals from future defamation. HLCG is very pleased that this 4 year burden has now been lifted and will allow HLCG to continue it's advocacy and make it possible for HLCG to focus on supporting Haringey Council leaseholders.
All parties agreed to publish the following statement:
“During 2009 and 2010, the then Treasurer of the Haringey Leaseholders Association (HLA) conflicted with Ms Brown and Mr Martin-Clark, the Chair and Press & Funding Officer regarding the direction of the HLA.
This led to regrettable difficulties which all concerned wish to put behind them in order to focus on meeting the needs of the leaseholders of Haringey. The HLA retracts its allegation that the ex-Treasurer misused the HLA’s database.
The ex-Treasurer recognises the right of the HLA to organise and represent its membership. Similarly the HLA recognises the right of other groups, including Haringey Leaseholders Campaign Group (HLCG), to organise and represent its membership.’’
